When the woman learned that he was not Jewish, she had him charged with indecent assault and rape. The complaint said that he presented himself as a single Jewish man seeking a romantic long term relationship. This week, he was convicted and sentenced to 18 months in prison by the Jerusalem District Court.
Tzvi Segal, the deputy president of the Jerusalem district court, along with his colleagues, Judge Moshe Drori and Judge Yoram Noam, wrote in their verdict that although this was not “a classical rape by force,” and though the sex was consensual between the two adults, the consent itself was obtained through deception and under false pretenses. “If she had not thought the accused was a Jewish bachelor interested in a serious romantic relationship, she would not have cooperated,” wrote the judges.
Judge Segal added that “The court is obliged to protect the public interest from sophisticated, smooth-tongued criminals who can deceive innocent victims at an unbearable price – the sanctity of their bodies and souls… When the very basis of trust between human beings drops, especially when the matters at hand are so intimate, sensitive and fateful, the court is required to stand firmly at the side of the victims … otherwise, they will be used, manipulated and misled, while paying only a tolerable and symbolic price.”
Can someone get me an Israeli lawyer for an additional opinion? Does this mean that if an American says that he plans to make aliyah, and doesn’t… he he liable to accused of deception? What if one of the sexual partners says he or she is in an elite IDF unit or a prestigious yeshiva. Is this also deception? (psst.. I am a pilot, but used to be in the Golani Brigade) I think that this verdict can change much of how the genders interact in Israel. Or am I woefully wrong?

I’ve seen these “what if he’d said…” comparisons all over the Web and it’s starting to bother me. Which forms of deception should be considered rape IS a sticky question, but the problem with these comments is the underlying message that having sexual relations is not such a big deal. Imagine if he had married her while trying to cast himself off as a Jew. Obviously that would be grounds for an annulment. Sexual relations should be viewed with the same seriousness.
Dan, we should review sexual relations with the same seriousness as marriage if the basis of the sexual relations had been something like growing companionship, not a one-night-stand. I suppose my gentlemen co-bloggers and commenters above are too delicate to use one, but there is a large range of words that can be used in reference to women who will consent to sex on a first meeting without really knowing anything about their sex partner. I sense part of what made people wonder in this case is the fact that a court would even admit such a suit, which from its premise denotes bias towards one religion respectively the assumed sanctity of its adherents. I can imagine there would have been judges that would have dismissed the case and told the plaintiff to get her sexual ethics straight.

James… excellent point. what if he was Jewish or converted to Judaism, but his status as a Jew was not recognized by the Chief Rabbinate of Israel. What if he was converted to Judaism by a rabbi in America and is considered Jewish in America, but not in Israel. What if he is Jewish in America based on patrilineal descent, but not in Israel. He then has consensual sexual intercourse in the State of Israel after saying he is Jewish. Can he be convicted of rape and indecency?
Also… what if a man says he is Jewish, he is rich, he is successful, he has a nice car, and he was in a prestigious military unit, and he turns out to be rich, successful, from a good military unit, but he is Druze and not Jewish. What is his sexual partner weighed all five attributes before deciding on consensual sex. Is just the Jewish part enough to be deceptive, or is it just 20% on a conjoint deception.
So what if a Jew (who is not recognized as such by the Rabbinate) proclaims his Jewishness in an attempt to have sex with a woman? Is that sufficiently deceptive?

an israeli court recently convicted a Jewish man who told a Jewish woman that he was a Housing Minister and could swap sex for an good apartment. He was jailed for deception, and perhaps rape as well.
also.. i think this is the same judge who let off a rabbi who mowed down an Ethiopian immigrant, since a conviction would hurt the rabbi’s chances at getting a seat on the religious court. WHAT????

If you take the decision seriously, how reasonable was it for the victim to rely on whatever she was told by someone trying to pick her up for what amounted to a one-night stand?…. Seems like the real motive here was protecting feminine virtue and enforcing the state’s paramount (sorry) interest in virginity– something the court shares with the Islamic Republic of Iran.

Duh. Of course the racial/ethnic aspect was the deciding factor! Who doesn’t lie to get booty? You go to a bar, meet a woman and pretend you’re interesting, or pretend you’re cosmopolitan, or pretend you’re polite and chivalrous, or pretend that your hair is naturally that straight…
This sounds like a very flimsy decision and this man’s conviction ought to be overturned on appeal, even if he is a scumbag sack of shit.

A pretty astounding decision. A criminal proceeding shouldn’t be about “protecting the public interest”, as the judge wrote, but about narrowly construing the criminal laws to insure only the guilty are sent to jail.
This seems an extraordinary expansion of the law of sexual assault as a means of policing extramarital sexual conduct generally.
I’m curious whether other people think the racial/ethnic aspect of the case was important to the result.
This ruling is incredibly retarded and the woman is incredibly gullible. She’s just pissed she gave into a one night stand. Who sleeps with a guy on the first date and thinks they have a chance to marry him? Idiotic, hoish women single men love.
